David Saxe and Michael Mix Author Article on Contractual Force Majeure Provisions and the Spreading Coronavirus.

The Hon. David B. Saxe, (ret.) and Senior Counsel, Michael Mix, authored the article “Contractual Force Majeure Provisions and the Spreading Coronavirus” that appeared in the New York Law Journal on March 9, 2020.

In the article, Judge Saxe and Mr. Mix analyze the doctrine of force majeure in contracts to see whether COVID-19 could constitute a force majeure event.  The article examines the factors that courts have employed in order to determine what constitutes a force majeure event, as well as the enforcement of such force majeure clause in the current environment.
