No. 127) to a mixed motive analysis to determine the extent of employees' protected activity and employers' ability to discipline and discharge employees for their use of foul and offensive language, even when exercising rights protected by Section 7 of the National Labor Relations Act, making it easier for employers to take adverse employment action against such employees.
