U.S. Dept. of Labor: Workers Who Refuse Job Offers in Unsafe Working Conditions May Still Collect Expanded Unemployment Benefits
July 27, 2020 - The U.S. Department of Labor recently released guidance providing that unemployed workers who refuse offers of work due to legitimate COVID-19 health and safety concerns may remain eligible for expanded unemployment benefits under the federal Coronavirus Aid, Relief, and Economic Security (CARES) Act of 2020. Such eligibility, however, is dependent upon how each state defines safe working conditions.
The following client alert discusses this guidance, at a time where Congress is debating whether or not to extend the weekly supplemental provision of $600 to workers collecting unemployment insurance benefits as a result of having been furloughed during the pandemic set to expire on July 31, 2020.
