U.S. Department of Labor Reminds Employers of Obligation to Track Hours of Compensable Work Performed by Employees Working Remotely

August 26, 2020 - On August 24, 2020, the Wage and Hour Division of the United States Department of Labor released Field Assistance Bulletin (FAB) No. 2020-5, which provides guidance on an employer's obligation under the Fair Labor Standard Act to track the hours of compensable work performed by employees, particularly those performed while employees work remotely due to COVID-19. 

This client alert summarizes that obligation and its limits, and discusses how employers should address this issue with appropriate and clear written policies distributed to and acknowledged by all employees.
