The HERO Act Amendments
Following its introduction into law on May 5, 2021, the New York Health and Essential Rights Act, otherwise known as the “HERO Act,” has been amended to provide clarity on certain parts of the law, including, among other things, the Act’s timeline for employers to implement airborne infectious disease prevention plans, the details surrounding workplace safety committees, and employees’ rights to pursue a private right of action under the law (the “Amendments”). The Amendments have been sent to Governor Cuomo and are widely expected to be signed into law in the near term. This client alert provides a summary of the Amendments and insights on how employers can prepare to comply with the law’s forthcoming requirements.
