Morrison Cohen Secures Summary Judgment and Attorneys’ Fees for Citywide RX in Contract Dispute Against Nursing Home Operators

Morrison Cohen recently secured a significant victory on behalf of client Citywide RX, LLC in a commercial contract dispute before the Court of Common Pleas, Cuyahoga County, Ohio.

The case involved the defendants’ failure to pay for pharmaceuticals provided by Citywide residents at several local nursing homes. On August 22, 2024, Judge Nancy A. Fuerst granted summary judgment in favor of Citywide on its claims for breach of contract, finding that the defendants had breached their obligations and owed payment for the pharmaceuticals delivered and invoiced by Citywide.

Following that ruling, on July 10, 2025, the Court granted Citywide’s motion for attorneys’ fees in full, awarding 100% of Morrison Cohen’s requested fees despite opposition requesting a two-thirds reduction. Judge Fuerst found that “reasonable minds could only conclude that Plaintiff is entitled to its attorney fees,” and further held that “Plaintiff has demonstrated that the rates charged by all counsel are reasonable, inclusive of law firm personnel as provided under Ohio law, and that the hours expended were likewise reasonable…”

This ruling marks a clear win for Citywide RX—securing not only recovery of amounts owed, but also legal fees resulting from the defendants’ breach.
