Y. David Scharf Discusses Opportunistic Investment in Commercial Real Estate in Commercial Observer

Morrison Cohen Partner Y. David Scharf, chair of the firm’s Executive Committee, was quoted in Commercial Observer’s analysis of the opportunities and challenges facing investors in today’s commercial real estate market, as higher interest rates and ongoing market dislocation reshape the landscape for opportunistic investment.

The article, “Where Opportunistic Investment Is Finding Deals in 2026,” examines how lenders, investors and property owners are navigating a market characterized by elevated borrowing costs, maturing debt, distressed assets and a growing need for new financing solutions. While market conditions are creating opportunities to acquire assets and provide capital to struggling projects, the window for opportunistic investment is increasingly competitive, with significant capital already pursuing available deals.

David observed that the window for opportunistic investment has narrowed somewhat because of the amount of capital chasing opportunities. He also noted that rapidly changing capital markets expectations have made lenders and investors more selective, exposing deals with insufficient financial cushions and underscoring the importance of sponsor strength.

“Disruption is a weed whacker — it takes out the deals that were too thin to begin with and creates opportunities for the deals that were built to last,” David said.

He further emphasized the importance of experienced sponsors and reliable capital partners as the market adjusts to higher interest rates. “It’s an amazing thing that the market keeps needing reminders that overleveraged or thinly underwritten deals with inexperienced sponsors are usually a recipe for disaster.”

David also discussed the growing shift away from the practice of extending troubled loans in anticipation of improved market conditions, noting that increased foreclosures and receiverships are creating opportunities for third-party asset managers to step in and take over projects.
