Morrison Cohen Obtains Motion to Dismiss for Real Estate Developer Client

The Morrison Cohen litigation team prevailed on the appeal of a denial of a motion to dismiss on behalf of a real estate developer client, where certain defendants involved with BCRE 15 Union Square West LLC, the sponsor of the 15 Union Square West condominium, were improperly sued by the board of managers along with the sponsor. The lower court denied these defendants’ motion to dismiss the last remaining claim against them in June 2022. The Supreme Court, Appellate Division, First Department decision removed this final claim against the defendants. Senior Counsel Joaquin Ezcurra represented the defendants in this action.
