Jessica Lipson Explores Quantum Computing’s Promise and Legal Risks in The Legal Intelligencer

Partner Jessica L. Lipson, co-chair of Morrison Cohen’s Technology, Data & IP Practice, published an article in The Legal Intelligencer titled “Quantum Computing Benefits and Legal Risk Considerations.”

In the article, Jessica explains how quantum computing, particularly when combined with generative AI, is poised to transform industries ranging from healthcare and pharmaceuticals to material design and advanced analytics. By leveraging quantum bits’ superposition and entanglement, quantum computers will eventually process information at speeds and scales far beyond what today’s most powerful systems can achieve.

Alongside the promise, however, come new challenges. Jessica highlights key legal and business risks that companies must anticipate, including:

  • Cybersecurity threats once traditional encryption methods become obsolete in the quantum era
  • Regulatory scrutiny under data protection laws
  • Jurisdictional inconsistencies as governments adopt quantum-related standards at different times and using different approaches
  • Vendor risks if partners fail to adapt quickly enough or don’t implement quantum hardening to their security programs

To mitigate these risks, Jessica recommends that businesses take proactive steps now, such as: adopting post-quantum encryption standards; engaging boards of directors in early planning; evaluating and renegotiating vendor contracts; and implementing policies to ensure readiness for the “quantum age.”

As Jessica notes, while quantum computing promises to be wildly transformative, the path forward will still require the tried-and-true basics: evaluate risks, make a plan, and implement mitigation strategies to ensure a safe transition.
