J.Crew Bests Landlord in Bid to Vacate Mall Lease
July 13, 2020 - In a recent New York Real Estate Law Reporter article, Danielle C. Lesser, Chair of the Business Litigation Department examines Eastview Mall, LLC v. Grace Holmes d/b/a J.Crew and J.Crew Group, where the appellate court rejected a mall's bid to stop J.Crew from closing a non-performing store.
The court highlighted the presence of a liquidated damages provision and the harm to J.Crew if it had to remain open. The lease's continuous operations provision could not stop J.Crew from closing its doors.
