Jason Gottlieb Quoted on Prediction Market Enforcement and Insider Trading Limits
Partner Jason Gottlieb was quoted in a Bloomberg Law article titled “Prediction Market Policing Will Test Insider Trading Law Limits,” which examines the challenges regulators face in policing alleged insider trading and misconduct in emerging prediction markets.
The article explores how the Commodity Futures Trading Commission is seeking to assert exclusive jurisdiction over prediction markets, even as it confronts legal and practical hurdles in applying existing anti-fraud frameworks. Unlike traditional securities markets, prediction markets often involve widely dispersed information, making it more difficult to establish key elements such as materiality and breaches of confidentiality.
Jason noted that these structural differences may limit the reach of current enforcement tools. “I think the government will find that it’s actually very, very difficult to apply the law as it currently exists to capture some of those cases,” he said. “Not all of them. Some of them, people really are using material, nonpublic information, violation of duties of confidentiality, and the usual law applies.”
He further emphasized that much of the activity drawing attention may ultimately fall outside the scope of insider trading law. “But I think people will be surprised when they learn just how much of the stuff that they’re seeing is actually not illegal and it’s not covered by insider trading law,” he said.
The piece also highlights ongoing disputes between federal regulators and state authorities over whether certain prediction market offerings should be treated as derivatives or as gambling, as well as recent enforcement actions signaling increased scrutiny of trading based on government information.
