Genny Ngai and Will Roth Discuss Rising AI-Related Crimes in Bloomberg Law
Morrison Cohen Partner Genny Ngai and Counsel William Roth published an article entitled “Rising AI-Related Sophisticated Crimes May Invite More DOJ Focus” in Bloomberg Law. The authors identify four key areas where AI is driving increasingly sophisticated criminal activity.
- Financial Fraud: AI is fueling increasingly sophisticated iterations of “pig butchering” scams and crypto fraud, with over 4,300 reported cases in 2024. The proliferation of deepfakes and fake digital personas will continue this trend.
- Cyberattacks: Agentic AI, which can autonomously execute tasks and adapt to victims’ responses, is enabling more sophisticated cyberattacks and data theft. The DOJ has already brought cases involving ransomware and crypto theft by foreign actors, and more are expected.
- Child Sexual Abuse: AI’s ability to generate images based on user prompts has led to a rapid increase in AI-generated child sexual abuse material in the U.S. and abroad. Recent DOJ indictments in Wisconsin and Alaska show active enforcement against the use of generative AI to create or manipulate explicit images of minors.
- AI Washing: Exaggerated or false AI claims – known as AI washing – have already prompted civil and criminal enforcement. In 2024, the SEC, FTC and DOJ all ramped up efforts to combat AI washing, taking action against several companies and individuals, including the first DOJ AI washing prosecution involving false investor claims about AI capabilities.
