Danielle Lesser Quoted in Law360 Regarding Restructured Retail Leases and Potential for Litigation in 2022
Danielle Lesser, Partner and Chair of the Business Litigation Department, was quoted in Law360 on how restructured leases based on retail tenants paying a percentage of gross sales to landlords may lead to a fresh round of litigation in the new year.
In the January 3, 2022 article, entitled, “The Real Estate Sectors Taking Center Stage In 2022,” Danielle said, "With regard at least to centers and malls… I'm looking at major landlords who have renegotiated a lot of their leases with major tenants... by lowering minimum rents." She continued, "What I am looking at is how those percentage rents are calculated," Lesser said. "We may see some litigation resulting from both sides having potentially different views of how that percentage rent is calculated."
