Daniel J. Studin Comments on QSBS Trust Stacking in The Wall Street Journal

Partner Daniel J. Studin, co-chair of Morrison Cohen’s Individual Client Services Practice, was quoted in a Wall Street Journal article entitled "Silicon Valley Is Obsessed With 'Trust Stacking,' and the IRS Doesn't Like It."

The article examines the rapid growth of a trust planning strategy known as “stacking.” Using this strategy, founders, investors and employees of early-stage companies can effectively multiply their Qualified Small Business Stock (QSBS) exclusion, resulting in significant additional tax savings on a successful exit over that which would be realized if no pre-exit estate planning had been done.

The article explores how the strategy has attracted increased scrutiny from the Treasury Department, which has signaled forthcoming guidance to rein-in what officials view as overly aggressive planning.
