Christopher Milito Defeats Motion to Dismiss Client’s Claims Over 16-Carat Diamond
February 22, 2019 – Morrison Cohen partner Christopher Milito successfully defended against a motion to dismiss an action and to remove the proceeding to Boca Raton. The Firm's client sued for the conversion of its 16-carat colorless diamond. After leveraging a $600,000-plus settlement from a co-defendant, Mr. Milito continued the pursuit of the primary tortfeasor, who moved to dismiss the complaint. Justice Ostrager of the Commercial Division rejected that motion and adopted the Firm's legal arguments that New York County was the proper venue for the continued prosecution of the claims.
