A Federal District Court in New York Strikes Down Four Key Provisions of the USDOL’s Final Rule Regarding FFCRA Paid Leave Entitlements

August 13, 2020 - In response to a legal challenge mounted by the State of New York,  U.S. District Judge J. Paul Oetken of the United States District Court for the Southern District of New York struck down portions of a U.S. Department of Labor's Final Rule providing guidance on interpreting the Families First Coronavirus Response Act.  As employers will recall, this Act is a new federal law that imposes certain paid sick leave obligations on, and expands the application of, the Family and Medical Leave Act for medium and small private employers.
