April 12, 2018 - Jason Gottlieb, Daniel Isaacs and Christopher Pendleton authored the article “Jurisdictional Overreach by Regulators in Cryptocurrency Actions” that appears in the April 12, 2018 issue of Law360.
The article addresses the tremendous uncertainty currently surrounding cryptocurrency regulation. While various regulators have claimed jurisdictional authority over cryptocurrency, no new legislation has been passed, no new regulations have been promulgated, and very few court decisions have addressed the issue of who, if anyone, has regulatory authority over cryptocurrency. The authors examine the few court decisions squarely addressing the question of whether cryptocurrency is regulated by the SEC, CFTC, some other agency, or no agencies at all.
