Jason Gottlieb Quoted in Article about Key Witnesses Going Sideways and How to Mitigate Damage
June 9, 2017 - Morrison Cohen Partner Jason Gottlieb was quoted about the key steps to keeping a witness who goes sideways from threatening your case in the article “Twist in London Whale Case Exposes Threat of Sideways Witness,” that appeared in the New York Law Journal on June 8, 2017.
"It's something that litigators live in fear of," said Morrison Cohen partner Jason Gottlieb.
In his work handling cases for clients facing regulatory enforcement issues from the SEC and New York Attorney General's Office, Gottlieb said there are key steps to keeping a worst-case scenario from trashing the best-laid plans. Preparation, he said, is absolutely critical.
"You have to know their role in the facts. You have to know the facts better and deeper than your witness will," he said.
Likewise, Gottlieb added, a trusting personal relationship with a witness helps to overcome any natural defensiveness over uncomfortable or unwanted questions that are critical to the case.
