Morrison Cohen Wins Dismissal for Israeli Tech Company on Jurisdictional Grounds

On March 15, 2023, the New York State Supreme Court for Rockland County, issued a decision granting dismissal of an action against the firm’s client, an Israeli information technology and software development company, that had provided tech services to the plaintiff, a New York start-up. The dispute raised jurisdictional questions regarding whether a New York court could exercise jurisdiction over Israeli parties for a cross-border transaction, where the foreign defendant had no presence in New York State.   

The Court found that the defendant had not “purposefully availed” itself of jurisdiction in New York merely by providing (in Israel) services to a company located in New York and dismissed the plaintiff’s complaint in its entirety.
