Kristin is a partner in the Firm’s Business Litigation Department. Kristin has practiced throughout the United States but appears primarily in state and federal courts in New York and various arbitral tribunals. She handles all phases of complex litigation, from pleading through trial and appeals.

Kristin has experience in a wide range of concentrations, including real estate, insurance, contract, and partnership disputes, and employment, patent, and trade dress matters. In addition to general business litigation matters, she represents real estate developers, property owners, and lenders in connection with ownership and development disputes. She represents employers in connection with a variety of employee- and former employee-related matters. She represents companies in connection with protection of Intellectual Property portfolios. Kristin also routinely provides advice in litigation avoidance and counsels clients in connection with litigation-avoidance techniques.

Experience

  • Represented client in amicus presentation to the Supreme Court of the United States in connection with trade dress dispute.
  • Co-counsel to client involved in multi-district defense of patent portfolio.
  • Obtained a dismissal from the Federal District Court and an affirmance from the Second Circuit, Court of Appeals on an antitrust claim brought against a publicly traded REIT relating to a casino development in New York.
  • Won a dismissal and an affirmance from the Appellate Division, Third Department in connection with a claimed restrictive covenant encumbering a casino development site.
  • Successfully defended a mortgage REIT against claims made by junior participants for breach of loan servicing arrangements.
  • Litigation in connection with defending mortgage foreclosure actions and negotiations concerning finance restructuring.
  • Litigation to remove managing members from LLC for breaches of fiduciary obligations and other for cause actions.
  • Litigation and administrative proceedings relating to school district zoning for developers and large scale residential developments.
  • Represent clients in connection with enforcement of restrictive covenants and non-solicitation agreements.
  • Defend clients against claims from claims from former employees.
