The New York State Department of Labor (NYSDOL) Develops a new Airborne Infectious Disease Exposure Prevention Standard
As previously discussed, the New York Health and Essential Rights Act, also known as the “HERO Act,” was enacted on May 5, 2021, with subsequent amendments providing further clarity on New York’s new law that aims to curb the spread of airborne infectious diseases at the workplace. On July 7, 2021, the New York State Department of Labor (NYSDOL) issued guidance on how employers should implement an Airborne Infectious Disease Exposure Prevention plan at the workplace, as required under the HERO Act. This client alert provides a summary of this NYSDOL guidance and outlines what employers must address when implementing their own exposure prevention plans in the event of an airborne infectious disease outbreak.
