NYLJ Reports on Latest Ruling in Battle Between Client Naftali Group and Holdover Tenant

An October 11 article in New York Law Journal discussed the recent stay-ruling in the multilayered legal battle between Morrison Cohen client, developer Naftali Group, and a lone holdover tenant at the Naftali-owned 215 West 84th Street.

The article detailed the months-long conflict between Naftali and the tenant, reporting on the Appellate Court’s recent ruling that Naftali’s $25 million lawsuit against the tenant will continue to be stayed in deference to its related holdover proceeding in housing court.

NYLJ reported that the tenant’s application for emergency rent aid, which protected him from eviction for up to a year, was recently rejected by New York State. Since the publication of the article, the holdover tenant’s appeal of that rejection was denied. Meanwhile, the original holdover eviction action filed by Naftali in housing court has been proceeding.

Y. David Scharf, who is representing Naftali in some of the litigation, declined to comment in the article, and was recognized by the author as “the well-respected Morrison Cohen litigator and chair of the firm.”
