June 12, 2020 - Law360 covered Morrison Cohen's representation of Ability Inc.'s CEO Anatoly Hurgin and Chief Technology Officer Alexander Aurovsky. Messrs. Hurgin and Aurovsky are defendants in an enforcement action brought by the U.S. Securities and Exchange Commission. The June 4, 2020 article, “Judge Weighs Israeli Contractor Execs' Bid To Skirt SEC Suit,” discussed U.S. District Judge Mary Kay Vyskocil's consideration of Messrs. Hurgin's and Aurovsky's motions to dismiss the SEC's complaint. Morrison Cohen attorney Jason P. Gottlieb argued the defendants' motion, challenging the SEC's claims that his clients made actionable misrepresentations in connection with Ability's 2015 merger with investment fund Cambridge Capital Acquisition Corp.
The case is SEC v. Hurgin et al., Case No. 1:19-cv-05705, in the U.S. District Court for the Southern District of New York.
