Morrison Cohen Assists Washington Nationals in Appellate Process Regarding Broadcasting Rights Payouts
Partners Hon. David B. Saxe (Ret.), formerly an Associate Justice at the Appellate Division, First Department for 19 years, and Gayle Pollack, an experienced appellate lawyer, often collaborate with outside counsel to augment their skills in pursuit of victory at the appellate level.
Saxe and Pollack collaborated with attorneys for the Washington Nationals to prepare for oral arguments before the New York Court of Appeals on March 14, 2023. The case centers around a long-running dispute over annual broadcasting rights payouts between the Baltimore Orioles-controlled Mid-Atlantic Sports Network (MASN) and the Nationals. Saxe and Pollack worked with the Nationals’ attorneys, Quinn Emanuel Urquhart & Sullivan LLP, to craft all the appellate briefs and provided valuable assistance in “moot courting.”
The Orioles and MASN urged New York's Court of Appeals to scrap their $105 million loss to the Nationals in the broadcasting rights battle, claiming that the Major League Baseball Commissioner steered a biased arbitration proceeding. The two teams have been involved in litigation since 2011 over the proper price for the Nationals' sale of broadcasting rights to MASN between 2012 and 2016.
Saxe and Pollack were involved throughout the very lengthy appellate process in this case, which involves important issues in the law of arbitration.
The case is TCR Sports Broadcasting Holding LLP v. WN Partner LLC et al., case number APL-2020-00175, in the New York Court of Appeals.
