CLIENT ALERT: Obama Administration Wants States to Limit Enforceability of Non-Compete Agreements

October 28, 2016 – President Obama asked state law makers to enact legislation that would significantly limit the enforceability of noncompetition agreements in the workplace.  As new legislation addressing non-compete agreements seem likely in many states and could significantly impact the use of such agreements in the future, particularly with lower paid employees, all employers should evaluate their current agreements with employees that contain restrictive covenants and consider whether modifications are necessary to better ensure that they remain enforceable in the future.  The attached Client Alert reviews the White House's proposals for state legislatures to consider.
