Jason Gottlieb Authors Article on Recent SEC Settlements and Possible Path Forward for Initial Coin Offering Compliance
December 4, 2018 – Morrison Cohen Partner Jason Gottlieb authored the article “The SEC’s Paragon Coin and AirFox Settlements: a Path Forward?” in the November 30, 2018 issue of Bloomberg Law – Securities Law News.
Jason analyses the SEC’s settlements with two issuers of “initial coin offerings” (“ICOs”) and the same day release of the SEC’s “Statement on Digital Asset Securities Issuance and Trading” and, whether taken together, the SEC is offering the possibility of a path forward to get older non-compliant ICOs into compliance.
The SEC’s latest moves leave open many questions for market participants. Although the SEC’s actions may be seen as a first step toward weighing regulation and investor protection against the promotion of financial innovation, it remains to be seen whether the SEC will correctly strike that balance, and whether the ICO market will transition to a more compliant “securities token” market.
