Y. David Scharf Comments on Efforts by Several States to Block Sprint, T-Mobile Merger

June 18, 2019 – Morrison Cohen Partner Y. David Scharf was quoted in the article “T-Mobile-Sprint Merger Appears to be in Major Trouble”, that appeared on June 12, 2019 in the New York Post.  Arguing that a merger between Sprint and T-Mobile would mean higher prices for consumers, New York Attorney General Letitia James, along with eight other states and the District of Columbia, sued to block the mega-merger between the wireless carriers.  David believes the merger suit will result in a high-profile case that gets an appeal as the FCC and DOJ have indicated approval for the merger.

“This is states' rights versus federalism,” as the FCC and DOJ are expected to support the merger, according to Scharf. “This could end up in the Supreme Court.”
