Morrison Cohen Obtains Order Restraining the Sale of a New Office Complex
March 28, 2018 – Morrison Cohen attorneys Christopher Milito and Michael Mix secured a temporary restraining order in New York State's Commercial Division blocking the sale or mortgaging of a newly-constructed office building. The complaint alleged that the Firm's client had been frozen out of management by its partner and that information concerning a multi-million dollar potential cash-out refinancing had been purposefully misrepresented to the client. Supreme Court Justice Ruchelsman issued the order and ruled that the Firm's client did not have to post a $2 million bond to secure that order. This order follows on the heels of a prior restraining order the Firm obtained blocking defendants from seeking to compel arbitration of the parties' dispute.
The case was filed in Kings County Supreme Court under the caption YMSF Family Partnership LP v. 5309 18th Ave Besyata LLC, Index Number 514791/2017.
