Morrison Cohen Obtains Dismissal of Fraud Claims Against Charitable Foundation

April 23, 2020 - Morrison Cohen was recently mentioned in the Law360 article, “Platinum Founder Can't Shake Suit, But His Foundation Can,” published on April 22, 2020.  
 
Morrison Cohen represents the Huberfeld Family Foundation Inc., a charitable and philanthropic foundation run by, among others, Murray Huberfeld.  The foundation faced claims of aiding and abetting breaches of fiduciary duty and fraud, as well as unjust enrichment, stemming from a larger alleged fraudulent scheme.  
 
The publication specifically recognized Judge Jed S. Rakoff's dismissal of all claims against the foundation, and reported on the Court's recognition that it, "could not find evidence that the Huberfeld Family Foundation Inc. provided" any assistance to the fraud alleged in the lawsuit.

The case is Trott et al. v. Platinum Management (NY) LLC et al. (Case No. 1:18-cv-10936).
