Gayle is a Partner in the Firm’s Business Litigation Department.

Gayle has handled a wide variety of business litigations from pre-litigation through trial, and has extensive experience in contract, joint venture, and partnership disputes, non-competition and employment litigation and complex real estate matters. Gayle is also an experienced appellate attorney, and has argued over 40 cases before New York’s appellate courts, including the state’s highest court, the Court of Appeals.

Prior to joining Morrison Cohen, Gayle clerked for the Honorable Kathleen Blatz, Chief Justice of the Minnesota Supreme Court, and was associated with O’Melveny & Myers LLP.

Experience

  • Obtained dismissal of Interstate Land Sales Disclosure Act claim against condominium sponsor.
  • Obtained dismissal of multi-million dollar fraud claims against biomedical research company.
  • Obtained favorable appellate decision permitting investor in Ponzi scheme to bring claims against law firm representing scheme principals in purported offerings.
  • Obtained emergency injunctive relief requiring property owner to immediately remove impediments to neighboring construction.
  • Obtained monetary and other sanctions against attorney and opposing party based on breach of court order.
  • Counsel in a 13-day bench trial in New York concerning the potential sale of an affordable housing property. Obtained a verdict in favor of the property owner.
  • Defended mortgage brokerage company in investigation by New York State Attorney General’s Office into collusive appraisal procedures, resulting in discontinuance of investigation.
  • Defended investment bank in a fraudulent conveyance action in federal bankruptcy court arising from debtor’s acquisition of a dot-com company.
  • Obtained reversal of robbery conviction based on newly discovered evidence proving complainant was not credible.
  • Obtained reversal of burglary conviction based on court’s improperly precluding expert testimony on mental illness.
