Our Strategic Case Review Practice is led by The Honorable David B. Saxe (Ret.) who served on the bench for 35 years, the last 19 as an Associate Justice, New York State Supreme Court Appellate Division, First Department before joining the firm.  He provides an impartial review from the perspective of an experienced judge on issues that are important to a judge and jury. 

We work with the client and/or its legal team as a set of “fresh-eyes” to review and analyze case strategy, papers or case options.  We have a reputation of working very collegially with other firms and respecting our and their role within the client’s legal team.

The firm offers a menu of flexible levels of existing case review:

  • Consult and Review
  • Audit and Edit
  • Moot and Mock

A Consult and Review engagement includes review of briefs and analysis of the underlying motion, trial or appeal strategy.  An Audit and Edit level of review typically involves a review of draft motion or appeal papers and drafting proposed edits to these documents.  A Moot and Mock engagement could involve mooting counsel in a mock oral argument for a motion or appeal or conducting mock opening statements, examinations or summations for trial.

The firm will tailor the scope of the Strategic Case Review engagement to accommodate the needs, goals and budget of each client and counsel.  In particular, Justice Saxe will be able to bring an experienced “fresh-eyes” approach to prenuptial, postnuptial and other marital agreements that need to be made as litigation-proof as possible.
