NYC Employees Can Now File Private Lawsuits for Safe and Sick Time Leave Violations
On March 20, 2024, amendments to the Earned Safe and Sick Time Act (ESSTA) became effective, enabling employees to have a private right of action to bring claims in court alleging violations of the ESSTA. Such actions must be brought within two years of the date the employee knew or should have known of the alleged ESSTA violation.
Employers should review their safe and sick time leave policies to ensure that they are compliant with the ESSTA and avoid unlawfully denying leave to an employee who qualifies for safe and sick time leave.
