Edward P. Gilbert is a Partner serving both the Firm's Commercial Litigation and Bankruptcy and Restructuring departments. Since joining the Firm in 1998, Mr. Gilbert has successfully handled a broad range of litigations, including officer and director litigation, partnership disputes, environmental disputes and other complex commercial disputes in both state and federal court.

Mr. Gilbert also has handled numerous contested bankruptcy matters, including Bankruptcy Rule 2004 investigative proceedings, equitable subordination actions, fraudulent conveyance/transfer actions, and preference actions.

Mr. Gilbert's recent representations include:

  • representing two former managing directors of Lernout & Hauspie Speech Products, N.V. in connection with multiple securities class actions;
  • representation of a national airline in connection with an environmental cleanup dispute at John F. Kennedy Airport;
  • serving as litigation counsel to the unsecured creditors' committee in the Schwinn/GT Corp. bankruptcy cases in Denver, Colorado leading to a successful resolution of lender liability claims against the debtors' senior lender;
  • successfully defending a private institutional investor in a case in which a Massachusetts court ruled that the investor cannot be held vicariously liable to a bankrupt company's creditors merely because the company's board of directors includes members designated by the private institutional investor;
  • successfully representing a large investment firm in dual shareholders' derivative actions pending in New York and Delaware state courts.

In his representation of individuals, corporations and creditors and debtors in bankruptcy court, Mr. Gilbert has handled all phases of litigation from pleading through trial verdict and appeal.

Before entering private practice, Mr. Gilbert served as an Assistant District Attorney with the Manhattan District Attorney's Office under Robert M. Morgenthau. During his tenure there, he conducted more than twenty trials.
